Deposit, Payment of Purchase Price, Fees
Buyer has paid a deposit of $...., with payment of the balance of $... due upon release of the cat to
Buyer. The expected delivery date is ../../2023, or such other date as the parties may mutually agree.
Payment of the balance may be made by cash, paypal, zelle.
In the event that the cat is not available due to sickness, death, or any other circumstance owing to the fault of Seller, Buyer's deposit will, at Buyer's option, be either (i) refunded, or (ii) transferred to the next litter of kittens.

Transfer of Ownership and Registration
Upon payment in full of the Purchase Price, Seller shall promptly take all actions required to officially transfer ownership and registration (if any) of the cat to Buyer.

Seller's Representations and Warranties
Seller represents and warrants to Buyer that:

Seller is the legal and true owner of the cat and that Seller has full right and authority to sell tire cat.

The cat is in good health and free of communicable diseases at the time of this sale. Health Certificate guarantees your cat sound healthy and been checked by certified Vet. Our cattery follows TICA Breeder Code of ethics and our kittens already spayed/neutered.

Buyer has 2 days from the delivery date to have the cat examined by a licensed veterinarian, at Buyer's sole cost. If the cat fails the examination, Buyer may return the cat, with a written statement from the veterinarian, for a full refund. Failure by Buyer to have the cat examined within the 2-day period will nullify this warranty. If Buyer chooses to keep the kitten, no replacement will be given and all medical costs and treatment are sole responsibility of the Buyer. This health guarantee will be null and void. No cash refunds after the 2 days guarantee period. This cat cannot be returned if it has been exposed to another cat that has not been currently tested negative for Trichomonas [PCR test only], FELV and FIP. If the cat must be tested for Trichomonas, FELV and FIP upon return, the costs will be deducted from any refund payable.

Bayer understands that seller will not pay any your vet expenses . We recommend to purchase Pet Insurance. All costs for return or replacement or Vet expenses of this cat are Buyers responsibilities.

Proof of first vaccination FVRCP and re-vaccination (booster)is provided with Health certificate. Rabies of course a separate issue,date is to be confirmed with your veterinarian.The Seller has a limited guarantee of 12 months from the cat’s date of birth from congenital genetic defects, unknown at time of sale and in accordance with the following criteria: If a genetic defect is found to be directly responsible for the severe disability or death of this cat during the first 1 year of life, the cat will be replaced when:
1) In the case of disability, this cat will be replaced only when a licensed Veterinarian certifies the cat’s quality of life to be severely diminished due to a permanent disability which is the direct result of a genetic defect. A description of the defect and relevant medical test results indicating the origin of the disability must be included in the disability certification.
2)In the case of death, this cat will be replaced only when a licensed Veterinarian performs an appropriate postmortem and certifies the cause of death to be the direct result of the genetic defect.
In that cases cat will replace with the first opportunity but no longer than One Year of issue.

Buyer's Representations
Buyer represents to Seller that:

The cat will reside with Buyer as companion pet to Buyer and Buyer's family.

Buyer will keep the cat in an enclosed area of adequate size, and will not allow the cat to roam at will.

Buyer will provide the cat with nutritious food and necessary veterinary care. It is Bayer responsibilities to provide enough fresh water and food to the cat. This cat will NEVER be declawed, as the amputation procedure is a painful mutilation.

Any and all veterinary care shall be solely at Buyer's expense.

Buyer is not acting as an agent for any other person or business in the purchase of the cat.

Buyer will not sell, give, or release the cat to a pet shop, retail store, cat dealer, animal testing facility, research facility, or an agent for any such business or facility.

In the event Buyer sells the cat to a new owner, Buyer shall ensure that the new owner agrees in writing to comply with the terms of this Agreement.
Indemnity and Release
If any action or failure to act on the part of Buyer shall result in any claim, suit, loss, damage, injury, death, or liability Buyer agrees to defend, indemnify, and hold Seller harmless and to pay all of Seller's costs and expenses, including reasonable legal fees, any amount paid in settlement and any award or judgment with respect thereto. Buyer release Seller from any and all liability, costs or damages caused by the cat after placement with Seller, including but not limited to damage to or destruction of property, and injury to any person.

Limitation of Action
Any action or claim brought by Buyer against Seller for breach of this Agreement or for loss due to negligence must be brought within one (1) year of the date such claim or loss occurs.

Governing Law
This Agreement shall be governed by and construed in accordance with the laws of New York.

Entire Agreement
This Agreement represents the entire agreement between the parties. Seller and Buyer have made no other agreements, promises, representations or warranties, express or implied, unless specifically stated in this Agreement.
